Workplace Drug Police Legislation

It is essential that your policy complies with all relevant legislation, including the Privacy Act, Human Rights Act, Employment Act, and Health & Safety at Work Act. We will help you understand your obligations under these acts, and make sure your drug and alcohol policy adhere to them. 

Testing must be conducted by a qualified technician according to the following standards:

  • Urine drug testing in accordance with AS/NZS 4308:2008 (or subsequent revisions)
  • All oral fluid drug testing in accordance with AS/NZS 4760:2019 (or subsequent revisions)
  • All alcohol testing was conducted with a breathalyser verified to AS 3547:2019 (or subsequent revisions)

Other Compliance Requirements

A workplace drugs and alcohol policy must be reasonable, and this will depend on a range of factors that we can explain to you. The aim of the policy should be prevention, education, training and rehabilitation. There should be a clear procedure in place for what happens if employees fail to follow the policy.

Every employee must be treated fairly and equally under the policy, no matter how senior they are. This process includes consulting with employees and getting their buy-in and support to create a safer workplace.
